Waiver and Release Policy

Davidson College has a number of curricular and co-curricular programs that offer students the opportunity to travel off campus. There are risks, known and unknown, that are inherent in any off-campus excursion.

In keeping with good risk management practices, the college seeks to limit its liability with respect to Off-Campus Programs or Events by requiring program participants to sign waivers and releases of liability.

All Organizers of Off-Campus Programs or Events shall require participating students to sign a notarized waiver and release of liability prior to participating in the Off-Campus Program or Event. All waivers and releases of liability shall be maintained for a period of three years.

"Off-Campus Program or Event" refers to any situation where an enrolled Davidson College student leaves the college campus and the surrounding campus community to participate in any program or event sponsored by Davidson College. Non-Davidson programs of study for which the college awards course credits are not sponsored by Davidson College.

"Organizer" refers to the individual who organizes an off-campus program or event.

Administration of Policy

The Vice President for Finance and Administration shall oversee this policy and review it at least once every two years. Changes to this policy shall be made in accordance with the college's Policy on Policies. Failure to comply with this policy may result in a verbal or written warning from the vice president for Finance and Administration. Repeated failures to comply with this policy may result in the cancellation of the Off-Campus Program or Event.

At least thirty days prior to the Off-Campus Program or Event, the Organizer shall submit a request to the vice president of Finance and Administration for a waiver and release of liability. The Vice President of Finance and Administration, or that officer's designee, shall provide a waiver and release of liability to the Organizer within fourteen days of the request.

All waivers and releases of liability shall be maintained by the organizer for three years.

This policy is designed to limit the liability of the college from claims by students arising from Off-Campus Programs or Events. This policy is not designed to protect students from liability for any intentional or negligent acts committed during off-campus excursions. Students are advised to take steps to limit their liability to the college or to third parties when planning or participating in any off-campus excursions.
